Terms of Service — PeopleHQ

1. Acceptance of terms
By accessing or using PeopleHQ, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
These terms form a binding agreement between you (the Organisation and its Users) and Multitech Solutions (“we”, “us”, “PeopleHQ”).
2. Description of service
PeopleHQ is a cloud-based HR and payroll management system. We provide software-as-a-service (SaaS) to Organisations for the purpose of managing employee records, attendance, leave, and payroll.
3. Accounts and access
- Each Organisation is responsible for maintaining the security of its account credentials
- You must not share login credentials between multiple individuals — each user must have their own account
- You are responsible for all activity that occurs under your Organisation’s account
- We reserve the right to suspend or terminate accounts that violate these terms
4. Acceptable use
You agree not to use PeopleHQ to:
- Store data you do not have a lawful right to process
- Upload documents containing Aadhaar numbers or other government identity document numbers beyond what is required for employment records
- Violate any applicable law, including India’s DPDP Act 2023 and applicable labour laws
- Attempt to access another Organisation’s data
- Reverse engineer, copy, or resell the software
5. Your data and DPDP obligations
You are the Data Fiduciary for your Employees’ data.
When you store personal data of your Employees (including PAN, bank account details, and attendance data) in PeopleHQ, you are acting as a Data Fiduciary under India’s DPDP Act 2023, and as an employer under applicable Indian labour law. This means:
- You are responsible for having a lawful basis to store and process your Employees’ personal data
- You are responsible for providing appropriate notice to your Employees about how their data is used, including those who do not have their own PeopleHQ account
- You must honour erasure and access requests from your Employees in a timely manner, subject to your own statutory retention obligations
- You are responsible for the accuracy of statutory and payroll data entered into PeopleHQ
Multitech Solutions acts as your Data Processor for this data and will process it only as instructed by your use of the platform.
6. Data processor agreement
By using PeopleHQ, you appoint Multitech Solutions as a Data Processor for the personal data of your Employees stored in the platform. We commit to:
- Processing data only for the purposes of providing the PeopleHQ service
- Implementing reasonable security measures (as described in our Privacy Policy)
- Notifying you of any personal data breach affecting your Organisation’s data within 72 hours of becoming aware
- Deleting or returning your data within 90 days of account closure upon request
- Not sharing your data with third parties except as described in our Privacy Policy
7. Intellectual property
PeopleHQ, its code, design, and all content created by Multitech Solutions remain the intellectual property of Multitech Solutions. Your Organisation’s data remains your property.
8. Service availability
We aim for high availability but do not guarantee uninterrupted service. We are not liable for losses arising from downtime, data loss, or service interruptions beyond our reasonable control.
9. Limitation of liability
To the maximum extent permitted by law, Multitech Solutions shall not be liable for indirect, incidental, or consequential damages arising from your use of PeopleHQ. Our total liability shall not exceed the amount paid by your Organisation in the 3 months preceding the claim.
10. Termination
We may suspend or terminate your access to PeopleHQ if you breach these terms. You may terminate your account at any time by contacting us. Upon termination, your data will be retained for 90 days and then deleted, subject to any statutory retention obligations applicable to payroll records.
11. Governing law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kolkata, India.
